Terms and Conditions

SERVICES PROVIDED

Cojack Auto Workshop ("Workshop") offers various automotive repair and maintenance services ("Services") as listed on our website. These may include engine repairs, transmission maintenance, air conditioning service, electrical system diagnostics, and exhaust repairs. Specific service details will be agreed upon directly with the client ("Client") at the time of service booking.

SCOPE OF WORK

The Services provided by Cojack Auto Workshop will include only what is explicitly stated in the work order agreed upon by the Client. Any additional work not specified will require a separate agreement and may incur additional charges. The Workshop reserves the right to amend the scope of work if unforeseen issues arise that require additional repair or maintenance work.

VERIFICATION OF IDENTITY AND OWNERSHIP

The Client must provide valid identification and proof of vehicle ownership or legal authorization to request services. Cojack Auto Workshop reserves the right to refuse service if the Client fails to provide this documentation.

DETAILED INSPECTION AND CONSENT FORM

Prior to commencing any work, the Client must sign a detailed inspection and consent form that outlines the vehicle’s current condition, the agreed-upon services, estimated costs, and any potential additional work. This form ensures transparency and mutual understanding of the work to be performed.

TERMS OF USE

By accessing and using our website, you agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your use of the site and the services provided by Cojack Auto Workshop.

FEES AND PAYMENT

Any fees for services will be provided upon request or after an initial consultation. All service fees are clearly communicated to the Client before any work begins. Payment terms will be agreed upon directly with the Client and are due upon receipt of the final invoice. For services exceeding RM5,000, full payment must be made before the vehicle is released.

NON-REFUNDABLE DEPOSIT

A deposit is required to secure your booking and commence the Services. This deposit is non-refundable. By paying the deposit, the Client acknowledges and agrees to all Terms and Conditions of Cojack Auto Workshop as stated on this page. Clients are advised to read these Terms and Conditions carefully before making any deposit payment, as payment will be considered acceptance and understanding of these terms.

NON-CIRCUMVENTION CLAUSE

The Client agrees not to circumvent these terms by engaging directly with any subcontractors or third-party suppliers that Cojack Auto Workshop may use for service provision. Any attempt to do so will result in immediate termination of service.

RIGHT TO RECLAIM COSTS

In the event of non-payment, Cojack Auto Workshop reserves the right to reclaim any outstanding balances through legal means, including hiring a debt collection agency. The Client agrees to cover all associated costs of these actions.

CLIENT RESPONSIBILITIES

The Client is responsible for providing accurate information about their vehicle, ensuring the vehicle is in a condition ready for repair, and removing any personal belongings. The Workshop is not responsible for any personal items left in the vehicle during the service period. The Client warrants that the vehicle is not involved in any illegal activities and that they have the legal right to authorize repairs.

OWNERSHIP AND AUTHORIZATION

By engaging Cojack Auto Workshop for services, the Client affirms that they are the legal owner of the vehicle or have obtained the necessary authorization from the legal owner to authorize repairs and services. The Workshop is not liable for any disputes or legal issues regarding vehicle ownership. If it is discovered that the vehicle is stolen or subject to any legal claims, Cojack Auto Workshop reserves the right to cooperate fully with law enforcement authorities and is not liable for any damages or losses resulting from such cooperation.

LIMITATION OF LIABILITY FOR DAMAGE OR LOSS

Cojack Auto Workshop is not liable for any damage to the vehicle or loss of personal items caused by events beyond our control, including theft, fire, or natural disasters. The Client is responsible for ensuring adequate insurance coverage for such events.

RIGHT TO REFUSE SERVICE

Cojack Auto Workshop reserves the right to refuse service to any customer at any time, especially in cases where the customer is abusive, threatening, or fails to comply with the Terms and Conditions.

NO LIABILITY FOR PRE-EXISTING CONDITIONS

The Workshop is not responsible for any pre-existing damage or faults not caused by the services provided. Any issues discovered during the service that were not caused by the Workshop will be communicated to the Client, who will decide on further action.

LIEN RIGHTS

Cojack Auto Workshop reserves the right to place a lien on the vehicle for any unpaid services, including parts, labor, and storage fees. The vehicle will not be released until full payment is made.

STORAGE FEES

If the Client does not collect their vehicle within 7 days after being notified of the completion of services, Cojack Auto Workshop reserves the right to charge a daily storage fee of RM50. The Workshop also reserves the right to retain possession of the vehicle until all payments, including storage fees, are made in full.

WARRANTY

The Workshop guarantees that all work will be performed in a professional manner consistent with standard practices in the automotive repair industry. The terms of any warranty, including duration and scope, will be specified at the time of service and discussed with the Client. Manufacturer warranties for parts, if applicable, will be honored.

USE OF IMAGES AND MEDIA CONSENT

By agreeing to our services, the Client consents to Cojack Auto Workshop taking photographs or videos of their vehicle, and potentially themselves, while on our premises or during the service process. These images and videos may be used for marketing, promotional, or advertising purposes, including but not limited to our website, social media, and other marketing channels. If the Client does not wish for their image or vehicle to be used in this manner, they must notify the Workshop in writing before the service begins.

LIMITATION OF LIABILITY

While we strive to provide the highest quality service, Cojack Auto Workshop shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services. Our liability to you in connection with any service provided is limited to the amount you paid for the service in question.

NO CHARGEBACKS OR PAYMENT DISPUTES

By agreeing to these terms, the Client waives any right to initiate chargebacks or payment disputes for completed work as agreed upon in the service contract.

INDEMNIFICATION

The Client agrees to indemnify and hold harmless Cojack Auto Workshop, its employees, and agents from any claims, losses, damages, liabilities, and expenses arising from the Client’s use of the Services or any breach of these Terms and Conditions. This includes any misrepresentation or fraudulent actions by the Client.

ACKNOWLEDGMENT OF RISKS

The Client acknowledges that there are inherent risks involved in automotive repair and maintenance. The Workshop is not liable for any issues arising from these risks unless due to gross negligence.

FRAUDULENT ACTIVITY CLAUSE

Any fraudulent behavior or attempts to deceive Cojack Auto Workshop will result in immediate termination of service and may be reported to law enforcement authorities.

DISPUTE RESOLUTION

Any disputes arising from these Terms and Conditions or related to the services provided by Cojack Auto Workshop will first be addressed through mediation. If mediation is unsuccessful, the dispute will be resolved through binding arbitration under the rules of the Asian International Arbitration Centre (AIAC) or another mutually agreed arbitration institution in Malaysia.

FORCE MAJEURE

Cojack Auto Workshop is not liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, or governmental restrictions.

CUSTOMER BEHAVIOR POLICY

For safety and respect, customers are expected to behave appropriately while on the Workshop premises. Customers must not enter work areas without permission and must treat all staff with respect. Failure to comply may result in refusal of service.

CHANGES TO THE TERMS

Cojack Auto Workshop reserves the right to modify these Terms at any time. Any changes will be posted on this page, and it is your responsibility to review these Terms regularly. Your continued use of the website following any changes indicates your acceptance of the new Terms.

GOVERNING LAW

These Terms and any disputes arising from or related to them will be governed by the laws of Malaysia.
